Qoala Care Terms and Condition

Introduction

  • These terms and conditions govern the use of Qoala Care and any related services provided by Qoala Technology Sdn. Bhd. (“Qoala” or “Company”). By using Qoala Care, you agree with these terms and conditions.
  • Qoala Care is a subscription service offered by Qoala to its motor insurance customers that provides car claim assistance services throughout Malaysia.

Eligibility

To use Qoala Care, you must be at least 18 years of age, a legal resident of Malaysia and a customer of the Company. By using Qoala Care, you represent and warrant that you have met these eligibility requirements.

Use of Service

You may use Qoala Care for personal and non-commercial use only. You may not use Qoala Care for any illegal or unauthorised purpose. The Company is not liable for any abuse or misrepresentation of Qoala Care. Qoala has the right to request additional information pertaining to the benefit redemption.

Benefit

  • 1. Dedicated Claims Support
  • - Claims support to assist your claim journey.
  • - Qoala will assign dedicated personnel to assist you in your claim journey.
  • - The personnel has the right to request additional information to perform this task.
  • 2. Additional 50km of towing mileage
  • - You are entitled to an additional 50 km of towing mileage within Malaysia on top of your current mileage provided by your insurer. The additional mileage including toll is then to be claimed from Qoala.
  • - The claim has to be made within 48 hours of the reported incident. The claim will be forfeited if your car was towed by a third-party tow truck.
  • - The total amount claimable is RM50 and is only valid once.
  • 3. Grab-and-Claim
  • - You are entitled to a claim of up to RM20 of your Grab fare within 24 hours of the reported incident.
  • - The claim has to be made within 48 hours of the reported incident.
  • - The total amount claimable is RM20 and is only valid once.

Disclaimer of Warranties

The Company makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the service or the information, products, services, or related graphics contained on Qoala Care for any purpose. Any reliance on such information is therefore strictly at your own risk.

Limitation of Liability

The Company shall not be liable for any damages whatsoever, including but not limited to direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use Qoala Care.

Indemnification

You agree to indemnify and hold the Company, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of Qoala Care, your violation of these terms and conditions, or your violation of any rights of another.

Refund

If you are not satisfied with your subscription, we offer a full refund within three (3) days of the subscription date. Refunds will be processed within 14 working days after Qoala has been informed of the cancellation of Qoala Care. The Company reserves the right to refuse a refund if any benefit has been utilised. Qoala also reserves the right to withhold a refund if we believe you have violated the terms and conditions of the purchase agreement.

Changes to Terms and Conditions

The Company reserves the right to change these terms and conditions at any time. Your continued use of Qoala Care following any changes to these terms and conditions constitutes your acceptance of the new terms.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia, without giving effect to any principles of conflicts of law.
